Holiday Accident Injury Claims | Package Travel Regulations 2018

When you’re looking forward to a well-deserved break, the last thing you need is to suffer a holiday accident injury that disrupts your travel plans and wrecks your holiday. If this has happened to you, you may well feel that you want to make a claim for the pain and suffering you have gone through, not to mention the spoiled holiday. How can you make a claim for an accident that might have happened thousands of miles away in a different country or even continent?

You may not know it but, if you had an accident on holiday, it might be covered by the Package Travel Regulations 2018. This means that you can make your claim here in the UK and claim for your holiday injury accident direct to the company that sold you the holiday in the first place. You don’t have to try to claim from the foreign hotel company in a foreign court and you don’t need a foreign lawyer. This obviously makes progressing your claim a whole lot easier and we at Stonehewer Moss Solicitors, can help.

What types of holiday accidents can I claim for?

You can make certain types of holiday accident injury claims using the Package Travel Regulations such as:

  • Trips or slips in the hotel or grounds, pool etc
  • Food poisoning from the hotel restaurants or bars
  • Transport accidents when travelling on transport arranged as part of your Package Holiday (airport transfers, beach transport etc)
  • Injuries arising out of the negligence of the staff
  • Injuries arising out of the condition of the hotel
  • Accidents that happen when you are on an excursion arranged through the Package Tour Operator

There are some common injuries that we often see, that happen to people on holiday, such as:

  • Cuts and lacerations from sharp edges, tiles, windows or mirrors
  • Sickness and diarrhoea from dodgy hotel food or drink
  • Broken hip as a result of a trip or a fall
  • Fractures, due to impact injuries sustained around the hotel or in road traffic accidents
  • Twisted ankle after slipping on wet surfaces
  • Skin conditions stemming from a dirty pool, spa or hot tub.

The above lists are non-exhaustive and there are lots more examples of occasions where you can make a claim for a holiday accident under the Package Travel Regulations.

How do I know if my holiday is covered by the Package Travel Regulations?

Holidays covered by the ‘Package Travel’ Regulations are those where you have both travel and accommodation arranged by the holiday company. This usually includes a flight to the destination country and accommodation at an hotel. There are other examples but the above situation is by far the most common. The holiday can be anywhere in the world.

Not only is your holiday injury or illness potentially covered by the Package Travel Regulations, but you can also claim for your financial losses if your package holiday is spoiled by an accident, illness or injury. For example you can claim for

  • Medical expenses
  • Loss of earnings
  • Out-of-pocket expenses
  • Loss of enjoyment of your holiday

The process of claiming compensation for a Package Travel Regulations case involves gathering evidence, submitting a claim to the tour operator, and hopefully negotiating a settlement.
