Do I Have to Go to Court for My Personal Injury Claim?
Understanding Court Involvement in Personal Injury Claims
One of the most common questions clients ask during their personal injury claims process is: “Will I have to go to court?” While it’s a valid concern, the good news is that it is very unlikely that you’ll need to appear in court. In fact, 99% of personal injury claims do not go to court. Let’s take a look at why.
In this video, Dominic Moss, Senior Partner at Stonehewer Moss Solicitors, explains why less than 1% of personal injury claims in the UK require the claimant to give evidence in court.
Why Most Personal Injury Claims Don’t End Up in Court
When making a personal injury claim, the most likely outcome is a settlement — either through negotiation or a formal settlement offer. If your case is strong, the opposing party is often keen to avoid the time and costs of a court trial, and will prefer to settle out of court. It’s only when negotiations break down, or both sides can’t agree on the merits of the case, that a claim may move to court.
At Stonehewer Moss, we’re experts in negotiating the best possible outcome for our clients. Whether it’s a case of a road traffic accident, workplace injury, or medical negligence, we always strive for a resolution outside of court. In most cases, once court proceedings have been issued, claims are settled long before anyone has to give evidence in court.
However, if negotiations do fail, and it’s clear that your case has merit, a trial may become necessary. But, rest assured, this is very rare. As Dominic Moss explains, “In all the years I’ve been practising personal injury law, I would say that less than 1% of claims actually end up with someone giving evidence in court.”
Preparing for the Possibility of Court
Even though it’s unlikely that you’ll have to attend court, you should still be prepared for the possibility. If your case is one of the rare exceptions, Stonehewer Moss Solicitors will be there every step of the way, guiding you through the process. We’ll ensure that you’re fully prepared should the situation arise, but rest assured that our expertise is focused on helping you avoid court if at all possible.
At the end of the day, your personal injury claim shouldn’t be something that causes undue stress. The reality is, most cases settle without ever seeing a courtroom. But if you’re one of the rare clients who does end up in court, we’ll make sure you’re supported by a team of professionals who understand the process and will fight for the best outcome on your behalf.
