A Simple Guide to Chronic Pain Compensation

Chronic pain is described as long-term pain or discomfort that lasts for longer than 12 weeks. Chronic pain is pain that cannot be alleviated by the usual pain-relief methods, or by treating the root cause of the problem. Chronic pain can be experienced all over the body or it can be felt specifically in certain areas, furthermore the pain can also be suffered either sporadically or constantly.

You could suffer chronic pain as a result of trauma or injury. After an event such as a traumatic accident, surgery or infection, the body’s pain receptors may stay active within the nervous system for several months, meaning that when your injuries have healed, the pain may linger. There are some circumstances where chronic pain is experienced without any evidence of damage to the body. Common causes of chronic pain include Fibromyalgia, Myofascial Pain and RSD (Reflex Sympathetic Dystrophy Syndrome) also known as Complex Regional Pain Syndrome.

Accidents such as slips, trips and falls, road traffic collisions and falls from height are often to blame for many chronic pain cases, these types of accidents can have a lasting impact on someone’s health, wellbeing and quality of life. These accidents happen frequently in workplaces or public spaces where potential hazards have been overlooked and as a result, employees or members of the public have been harmed. If you have sustained a chronic pain injury through no fault of your own, it could be due to someone else’s negligence, in which case you could be entitled to make an injury claim.

We are unfortunately very aware of the impact that chronic pain can have on someone’s personal and professional life. Thankfully, with the years of knowledge and expertise our team have in handling this type of claim, we have already been able to help many clients obtain the compensation they deserve.

What are General and Special Damages?

The compensation calculator can help you estimate the out of compensation you might receive for your injury claim. This part of your compensation is known as General Damages, as it relates to the pain, suffering and loss of amenity that you have suffered as a result of your accident.

  • Pain: refers to the initial pain you suffered when your accident occurred.
  • Suffering: refers to the ongoing pain that you have endured since the accident.
  • Loss of amenity: refers to the fact that you could either for a period, or permanently no longer do something that you could do prior to the accident, for example play a sport.

The compensation calculator does not include other losses that you might have incurred as a result of your accident. Such as, loss of earnings, cost of care or damage to property. These items are known as Special Damages and can be claimed in addition to the General Damages mentioned above. The amount of compensation you receive will ultimately be made up of General and Special Damages, that is your injury claim and financial losses.
