So, you’ve decided it’s time to part ways with your employer. After discussions with HR, they’ve made you an offer that you’re ready to accept. Now, you’ve been advised to sign a Settlement Agreement in the presence of a solicitor and wonder, who pays the solicitor for a settlement agreement?

This is completely standard. A Settlement Agreement is a legal document that outlines the terms of your departure, ensuring both you and your employer are clear on the agreed terms, with no room for disputes later. Typically, your employer will draft the agreement and send it to us—should you choose us to represent you—to ensure you fully understand the terms before you sign.
For a Settlement Agreement to be legally valid, it must:

- Specify the dispute or termination of employment it resolves
- Be explained to you by an independent solicitor
- Identify the solicitor by name
- Clearly outline the obligations of both parties

Who pays the solicitor for a settlement agreement?
Your employer is responsible for covering the reasonable costs of the solicitor for the Settlement Agreement. This ensures you have the opportunity to review the document with an expert familiar with the legal language and sign only if it reflects the agreement you intend to enter into.
